Yes, seeing a spoiler up is not an indication of speeding. While it automatically rises based on speed, you can also manually raise it.I think a cop has to actually seeing you speeding, not some indicator you might have been speeding. BTW, my spoiler rises at 62 mph (2016 base conv), which for europhiles, is 100 kmh.
You can only manually raise the spoiler if the car is not moving. This is so you can clean under it.
